Terms of Service

The Service is operated by Joyvill Inc., Toronto, Ontario, Canada ("we", "us").

Two different kinds of people use it, and these terms apply to both:

• An organization — usually a church — that subscribes to the Service to manage its own membership, courses and attendance.
• A member of such an organization, who uses Attendly Card to see their own card and their own attendance.

Where an organization has signed a separate written agreement with us, that agreement governs and these terms fill in anything it does not cover.

This is the most important thing on this page. If you are a member, the information about you in the Service — your name, your contact details, your attendance, your enrollments — was put there by your organization, and your organization decides what to do with it. We store and process it on their behalf.

So: questions about your membership, corrections to your attendance, and requests to be removed from a roster go to your organization. We can help with the app, and we can delete your account (see Delete your account), but we cannot change your organization's records for them.

An organization using the Service is responsible for having the right to hold the information it enters, and for complying with the privacy laws that apply to it.

Attendly Card signs you in with your phone number and a code we text to it. Keep control of that number and of the device it reaches, and do not share a verification code with anyone. We will never ask you for one.

Staff accounts on the web platform sign in with an email address and a password, and may additionally use a PIN, a passkey or two-factor codes. Keep those to yourself; you are responsible for what is done with your account.

Tell us or your organization promptly if you think someone else has got into your account.

The Service is not directed at children under 13. An organization may hold records about children as part of its own membership, entered and controlled by that organization.

Please do not:

• Try to reach data belonging to a person or an organization other than your own.
• Check in as someone else, or use a card or badge that is not yours.
• Probe, scan or interfere with the Service's security, or attempt to bypass a rate limit or an authentication step.
• Use the Service to send unsolicited messages, or to break any law that applies to you.
• Copy, resell or redistribute the Service, or use it to build a competing product.

We may suspend access that is causing harm to the Service or to other users, and will tell the affected organization when we do.

What you or your organization put into the Service stays yours. You give us permission to store, transmit and display it only so far as is needed to run the Service for you.

We do not sell it, we do not use it to advertise to you, and we do not use it to train models for anyone else.

We aim to keep the Service running, but we do not promise it will be uninterrupted. Check-in works offline on the kiosk and syncs when the connection returns; that is a design choice precisely because a service on Sunday morning cannot wait for us.

We may add, change or remove features. If a change would meaningfully reduce what an organization relies on, we will give reasonable notice.

A member can delete their account at any time — from inside Attendly Card, or by asking us. What is removed and what is kept is set out in full on Delete your account. It is permanent.

An organization may end its subscription in line with its agreement with us. Its data is handled as described in our Privacy Policy.

We may end or suspend access for a serious or repeated breach of these terms.

The Service is provided "as is". To the extent the law allows, we make no warranties of any kind about it, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.

Attendance records, course completion and reporting are only as accurate as what is entered and scanned. They are your organization's records, not our determination.

To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost data, revenue or goodwill.

Our total liability arising out of the Service is limited to the amount paid to us for it in the twelve months before the claim arose, or CAD $100 if nothing was paid.

Nothing here limits liability that cannot be limited by law.
